SOLICITOR MOONEY'S REPLY TO THE OFFICE OF OPEN RECORDS

Reply to Solicitor Mooney’s reply to the Office of Open Records.
The above letter was sent to the Office of Open records by Borough Solicitor Mooney after Borough Secretary Bonnie Bray and Head of HU Caruso told me personally that the Purchase Order did not exist and Blonder Tongue Laboratories Inc. stated there were no open purchase orders for Kutztown.
The above letter states the Purchase Order exists but is not a borough record. Without looking any further there is a disagreement between Secretary Bray, Information Technology Director Caruso and the Borough Solicitor Keith Mooney. I state the Purchase Order exists and is a record. It exists because is appears on the March 17, 2009 Council Meeting agenda and was approved to be ratified at a Committee Meeting which qualifies it to be a record.
This is a deliberate and deceitful effort by the Borough to deny public access to the P.O. because it is part of the conspiracy by the Borough to rig the bid for the head end transition to Digital contract for $119,511.87.
I think this is a criminal act and being Blonder Tongue Laboratories Inc. is in New Jersey this could also be a violation of Federal Law. G.A. Marino P.E.
