Dear Editor,
Thank you for the informative Article by Mary Young about the Court Hearing of Marino vs. The Borough of Kutztown February 27, 2011. The hearing February 8, was for the enforcement of a “Final Determination” of the Pennsylvania Office Open Records which ordered the Borough to turn over to me certain financial records of the Telecommunications business venture after investigating my request. The fact is Judge Jeffrey L. Schmehl overturned the decision of the Pennsylvania Office of Open Records even though the Borough presented the same argument they gave to the Office of Open Records. Judge Jeffrey ruled the Borough gave me what they have which was the Borough Audit of the Borough General Fund. This proves that the Borough has never published a financial report on Telecommunications since its inception in 2002, 8 years ago which I stated in Court. Judge J.L. Schmehl did not have grounds to overturn the “Final Determination” of the Office of Open Records which is a duly legislated Agency of the Commonwealth. I intend to appeal this decision to the Commonwealth Court.

Dear Mr. Marino,
I did not come into town riding a white horse making promises I could not keep, and as mayor you did nothing but disgrace the office and the community. You choose to sell out Home Town U to a rival competitor because you failed as an elected official and was not re-elected. You chose to take revenue away from HTU so it would look bad. If you were in the military it would be considered treason. I'm wondering if your loyal followers realize every time you that the Boro to court it cost every taxpayer money. Who are those who are paying your court fees? We have a wonderful community with great services such as police and fire services of which I am a proud member. Our Mayor and Council have tried to clean up the mess that you made. A great man will admit defeat but an evil man will seek vengeance. You are a venomous man who seeks to destroy the quality of life in this community. I too am a veteran with many degrees and fought for the very freedom we have today. That freedom allows us to live where we choose to persue happiness. I chose to live here because of the quality of live for me and my family. You to have the same choose and if you are not happy here my suggustion would be to move on and find happiness.
I agree with GMK. What have you ever done to improve the quality of life for this community? Revenge, spite, and UNPROVABLE comments from you are all that is left of your sad existance. You walk around this borough with your head held down into your shoulders hoping upon hope that someone will at least talk to you. Don`t you get it? You stroll around Renninger`s market on weekends handing out your propaganda leaflets to vendors who do not even live in Kutztown. Are you so desparate? And as i have said before, you have yet to show ANY WRITTEN PROOF of accusations made against the borough. I beg you, PLEASE go away!
