Corruption Explanation 5-1-09 Gennaro A. Marino P.E.
To sum up my actions of questioning and accusing the Borough of lying about and rigging a bid with contractor Blonder Tongue Laboratories Inc of Old Bridge, N.J. In early March the Borough had a Purchase Order with Blonder for $119,511.87 and as per the Meeting agenda was going to ratify it at the March 17, 2009 Council Meeting. I stated it was illegal because it was not bid publicly and the Council removed it from the agenda and put the contract out for bid. Under the Right to Know law I asked to see the Purchase Order. I received a reply in writing from Borough Secretary\Right to Know Officer Bonnie Bray that the Purchase Order does not exist. I was also told personally by Secretary Bray and Information Technology Director Caruso that the P.O. does not exist. I appealed the RTK decision to the Office of Open Records and Borough Solicitor Keith Mooney replied to the OOR stating that the P.O. was not a record and the Borough did not have to produce the P.O. My blog of April 29, 2009 is a scan of the letter from the OOR to Solicitor Mooney stating his explanation disagrees with Secretary Bray’s reason.
Solicitor Mooney is now in the process of answering the Office of Open Records.
The point I am making is that the Borough does not want the Purchase Order made public because it shows the Borough had an agreement with Blonder for $119,511.87 without a bid or even a check price. This P.O. clearly exposes the conspiracy that the Borough was rigging a bid to give the contract to a predetermined bidder at a predetermined price which is a criminal act.
This P.O. is a public record but the Borough does not want it made public because it is incriminating. Mayor Green, the Borough Council, Borough Manager\Treasurer Khalife, Assistant Treasure Samilo, Borough Secretary Bray, ITD Caruso are all aware of what is going on and are all part of the conspiracy . The Borough Elected Officials can be indicted and can be sued personally because they knew the bid was illegal at the time of the vote. There is much more to this incident which I am sure will come out at a later date.

The only conspiracy is the one created in your own head. In reading your letters and request one can not help but notice how convoluted and confused you are.
Even if the Borough had a PO which was not ratified as you claim, means what? It was a document not approved, cancelled, deleted whatever, so how does that prove to be any conspiracy? You always seem to take the evident and information already available to the public and play "Monday Morning Quarterback".
As far as the Borough deciding to go out to bid, what was the result? The same company answered, and one you state submitted a response that was incomplete, so why would you expect their response to have a different amount than the amount they initially provided to the Borough to create a PO?
You fail to answer the most evident and bypass common sense. This is probably why you have nothing to show for your efforts. When all said and done, should the Borough provide a PO that was created, tagged as deleted, the question still remains, what do you have? Really, nothing more than a cancelled PO. Makes sense to me the Council had a PO to ratify, doesn’t it? I mean, were they supposed to authorize the creation of a PO or ratify an existing PO? You need to use some common sense here.
Somewhere along the way the Borough representatives you mention said they did not have a PO, according to your written claims, well common sense again, and this is from your own postings, if the PO was not ratified, it makes sense that it no longer can exist as a live document after the meeting was held becuase it was not ratified.
Am I missing something here? Somebody help me please, I am not totally in favor of the Borough and some of the players, but I can't stand to see people attacked for no reason other than exploitation.
Mr Marino, what does all of this prove and more importantly, what do you think is going to change? The Hometown Project is continuing according to the Borough minutes, the channel TV 2 is still planning the upgrade, so what have you accomplished?

One more question, would you shop a store and support them if you did not like the store? So why are customers of Hometown continuing to be customers? Why pay for a product or service you don't think people want?
As a matter of information, the cost to answer each Open Record Request from Mr Marino to the Borough is in the nighborhood of $200. PAID FOR BY THE RESIDENTS OF KUTZTOWN BOROUGH.
At $200 Bills a pop we could hammer the Borough Budget and break the bank. I think we should follow Mr Marino's lead and each of us make five to ten requests everyday for the next thirty days! That will teach the bastards to mess with us.

WHAT! you are telling me that everytime this guy makes a request to the Borough it is costing me $200? That's absurd, why doesn't Marino pay for this? Why am I paying?

To all you who post positive comments to the Marino blog, i want to remind you of a few facts. First of all, Marino has cost the borough hundreds of thousands of dollars in frivolous requests, lawsuits, increased insurance premiums, building modifications to keep him at bay, abuse of police vehicles for personal use, etc, etc, etc, etc. Also bear in mind that this is a man of very low character. Anyone ever question as to why he would move from Brooklyn, New York to an obscure little town such as Kutztown, to begin with? He is a man on the run. He has a very poor record with women, has been divorced by his wife, has been dis-owned by his 3 children, has a dishonorable Air Force discharge, and does not have an engineering degree as he wants you to believe. I can go on and on about this man. I have spent quite a bit of my own money and time to have him investigated, so i know why he is so miserable, and tries to make everyone else miserable as well. He is and has been a failure all of his adult life. Gennaro Marino, PE, indeed. PE meaning public enemy!
My question to Mr. Marino is simple, who's winning? It seems to me that you take the time to draft a bunch of request,abusing the right to know act, submit it, wait a week or longer, get a response, write a threatening letter about why you have been denied, then file an appeal, wait a month for a response, in between write three or four more letters. Then write a nsaty letter to the people that deny your appeal. To be perfectly honest with you Mr. Marino, you are being played. You are strung out for long periods and you have to spend hours crafting repetitive letters. I personally have to tell you that I think the Borough is making out on this deal. On the other side of the coin, the taxpayers of Kutztown are paying your bill. I think the citizens of Kutztown should contact the ACLU and file a grievance against you for spending their money without their approval, violating their civil rights. You should be held accountable for the increase in rates and fees because of your impact to the Budget. Seems like you are running around in circles. If what the previous writer said is true, I can understand why you are spending so much time writing repetitive letters. The Blogger "auditor" is right, in the end, what are going to get? a piece of paper? How does that stop the Hometown Project you are fighting?

Anonymous: I have already shown the proof to the proper authorities. You don`t see Mr. Marino denying any of my allegations, do you? I will publish MY truth when he shows all of us his proof. He started all of this, remember?
OK, let's say the proof shows Marino was not honorably discharged from the military, and he is on the run from his previous life, and let's say his family has disowned him, let’s say he is not a licensed engineer (PE) as he claims, what does he achieve by being the town bully? I know previous writings mention the disease "narcissism", which makes sense in this situation but who is he trying to impress? As far as getting himself elected to public office that's gone he proved he couldn't do anything any better than anyone else. He is expending taxpayer monies, burning the Borough's cash at our expense. Is he that angry and belligerent an individual to cause pain for the senior citizens and others in this community? His past may be a direct link to his current actions but all I know is this, the Borough rates will continue to rise and part of this is due to the miscellaneous bull caused by this person. As previously mentioned, the requests Mr Marino is making is not at his personal expense ecept for copying fees. The cost of time the Borough employees spend researching his requests, the review by the attorney's, and the preparation of the response are charges Mr Marino is not required to pay. I found this out last week at a meeting at Borough Hall, the charges racked up this year alone could fund a new walking trail.
So who is paying the bill?
For some of you simpletons the answer is, we the residents of Kutztown.
The real question, above all, is why anyone needs to actually use the Right To Know Act to see Borough documents.
It is blatantly obvious that The Kutztown Borough Council is trying to hide something.
For any council members who read this blog, please don't force your constituents to resort to RTN requests to get information.
Until the Borough is more forthcoming with what's going on behind closed doors, Jerry is quite right to continue to press for access to records and documents.

Unfortunately, the above responder is misinformed. The law now dictates that requests follow The Right To Know Act. The reason for this is due to documentation of requests and the release of information, otherwise all you have is someones word, which is exactly why a formal process was created.
If you think back, Marino was always claiming he never received information. He was on a constant kick to claim that he was not answered, couldne't get reports etc. To combat this type of behaviour the State, not the Borough Council, created the Right To Know to document requests and response's. Now there is no choice. The punishment, Tax payers pockets are under attack. Sometimes you have to be careful what you ask for.
Last week there was a special meeting held to answer questions about services, rates, and other questions posed to the Borough. The turn out (of course minus Marino) 15 people. More than 1/2 were Borough Officials and employees. So where were the people supposedly in support of Marino? A few of you want to blame the Council but you never seem to surface in Public to pose your questions, evidence you don't want to know the answer, supporting Marino's blurt out in public "I don't want to know the truth".
What I don't understand, and puzzeled about is why people from Kutztown don't speak out at the polls? If you don'tlike what is going on and you want to blame the elected officials, why not vote in new officials. I don't blame qualified people for not running for office after seeing people like Marino, pass blame, make accusations but do absolutely nothing to provide answers. Mr Marino from what I gather was at one time an elected Official, apparantly not a good one when he had his chance, so now he wants to blame those still in office. Sounds like sour grapes to me
